1. Acceptance of Terms

By texting our telephony number at (505) 448-8007 or accessing our web portals, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not text the number or use the web services.

2. Description of Service & Rates

MetroSMS provides real-time public transit arrival predictions, schedule lookup, and departure alerts for ABQ RIDE and UNM Lobo Shuttles via SMS.

• Message Frequency: Recurring based on user queries and scheduled departure alarms requested by you.
• Standard Rates: Message and data rates may apply depending on your mobile carrier plan.
• Supported Carriers: Compatible with all major US mobile carriers including AT&T, T-Mobile, Verizon, Sprint, Assurance Wireless, Boost Mobile, Cricket, and Metro by T-Mobile.

3. Non-Emergency Transit Notice & Disclaimer

Notice: MetroSMS is an independent technology provider and is not a municipal agency or emergency dispatch service. For life-threatening emergencies, dial 911. For mental health support, call or text 988.

Transit arrival estimates are derived mathematically from General Transit Feed Specification Real-Time (GTFS-RT) feeds provided by transit operators. Traffic conditions, weather, detours, and vehicle breakdowns may alter actual arrival times.

4. Advertiser & Sponsorship Terms

Businesses utilizing our Sponsor Portal agree to:

  • Submit accurate, truthful, and lawful promotional taglines (maximum 70 characters).
  • Comply with all FTC advertising guidelines, TCPA regulations, and municipal transit standards.
  • Prohibit promotions relating to adult content, illegal substances, deceptive financial schemes, or hate speech.
  • Accept that all sponsorships are subject to administrative moderation and approval before live broadcast.

5. Limitation of Liability

To the maximum extent permitted by applicable law, MetroSMS LLC shall not be liable for any indirect, incidental, special, or consequential damages resulting from missed bus connections, schedule delays, or carrier network outages.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of New Mexico, USA, without regard to its conflict of law provisions.
